These Terms and Conditions (“Terms”) govern the provision of outdoor construction services by Timothy Pergola (“we,” “us,” “our,” or “the Company”), operating from 107 Blackcastle Lodge, Flowerhill, Navan, County Meath, Ireland, to customers (“you,” “your,” or “the Client”).

By engaging our services, requesting a quote, or accepting our proposal, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.

2. Services Provided

  • We deliver bespoke pergola installation, wood panels, gates, lean-to sheds, doors, windows, and associated outdoor construction projects.
  • Our services cover all of Ireland, focusing primarily on Meath and Dublin but including nationwide delivery.
  • Initial site survey and measurement visits are offered free of charge.

3. Quotations and Pricing

  • Upon measuring and assessing your project site, we provide a detailed written quote outlining costs, scope, and timeline.
  • No work begins until the quote is approved in writing by the client.
  • Quotes are valid for a specified time (e.g., 30 days) and subject to change if materials or labour costs fluctuate.

4. Payment Terms

  • Deposits of 5-10% are required before work commencement, securing material orders and scheduling.
  • Final payment is due on project completion, upon client satisfaction or as agreed in the contract.
  • We accept payments via bank transfer, debit/credit card, and cheque.
  • Late payments may be subject to additional fees or interest as permitted by law.

5. Project Timeline

  • Project duration varies between 1 and 5 days, depending on size and complexity.
  • We aim to adhere to scheduled dates but reserve the right to adjust due to weather or unforeseen delays, notifying clients promptly.
  • Permits and approvals handled by us to ensure compliance with local planning and building regulations.

6. Permits and Compliance

  • We assume responsibility for obtaining any necessary permits and ensuring compliance with Irish building codes.
  • Clients must provide access and any existing documentation required for permit applications.

7. Client Responsibilities

  • Clients agree to provide safe and reasonable access to the site during working hours.
  • Any undisclosed conditions or hazards affecting the site may result in modifications to scope or pricing.
  • Clients must inform us of any changes promptly.

8. Materials and Workmanship

  • We use quality materials appropriate for Irish weather conditions.
  • With attention to structural integrity, safety, and aesthetic quality.
  • In accordance with best practices for outdoor timber construction.
  • By experienced, skilled craftsmen and to professional trade standards.

9. Cancellation and Termination

  • Clients may cancel service requests prior to scheduling without penalty.

  • Cancellations after deposit payment may incur fees to cover material and labour costs.

  • Either party may terminate the agreement with reasonable notice for breach or non-performance.

10. Liability and Insurance

  • Timothy Pergola holds all insurance coverage required by Irish law for public liability and employer’s liability.

  • We are not responsible for damage to structures or content outside the agreed work scope unless caused by our negligence.

  • Clients should maintain their own property insurance.

11. Dispute Resolution

  • We promote open communication to resolve concerns amicably.

  • Should disputes arise, both parties agree to attempt mediation before legal proceedings.

  • Governing law is Irish law, and courts of Ireland have jurisdiction.

12. Privacy and Confidentiality

  • Personal data collected will only be used for service delivery and communication, complying with GDPR.

  • Client information will not be disclosed to third parties without prior consent unless legally required.

13. Amendments

  • These terms may be updated periodically with notice provided on our website or via direct communication with existing clients.
